OUTCOME: Appeal to the NJ Appellate Division (denied)

Appealed to the NJ Appellate Division on several issues, one being the right to confront the chemical analysis who prepared a report in preparation for trial. Cited a defendant's Sixth Amendment right ... to confront all witnesses against him/her. Appellate Division denied the appeal. However, shortly thereafter the U.S. Supreme Court ruled that similar reports are testimonial and defendants have a right to confront all witnesses, including the person who prepared the report. Accordingly, this case may be appealed to the NJ Supreme Court.
