Mr. Senawi represented the homeowner who was sued by the general contractor, recei ... ving an award of no cause of action on the general contractor’s claim against his client, while obtaining a $50,000.00 award on his client’s counterclaim for breach of contract.
OUTCOME:
Acted as lead trial counsel in lawsuit against a Michigan partnership and two individual guarantors who were sued by a banking institution claiming damages in excess of $1.3 million dollars for default ... ing under commercial loan documents and for breach of their personal guaranty agreement. Mr. Senawi obtained summary disposition against the bank in favor of his clients limiting the amount the two individual guarantors owed under their guaranty agreement to 50% of the total debt as a unit—as opposed to 50% each as claimed by the bank. After this victory, the case was ultimately resolved pursuant to a settlement agreement and the bank’s lawyers were sued for malpractice.
OUTCOME:
Acted as second chair trial counsel representing our client was sued for over $14 million dollars based upon an alleged “oral agreement.” Mr. Senawi drafted the motion for summary disposition that was ... granted by the Court absolving the client from any liability.
OUTCOME:
Acted as lead trial counsel in Ponzi scheme litigation case arising out of one of the largest Ponzi schemes in Michigan’s history where innocent investors were duped in an amount that has been reported ... to be over $200 million dollars. Just like the Bernie Madoff cases, innocent investors were sued under the fraudulent transfer act to recoup monies from investors who allegedly profited off of the scheme. Over 500 cases were filed in Oakland County Circuit Court in a consolidated action to collect money from the innocent investors. Mr. Senawi represented and counseled 8 different families who were sued, structuring favorable settlements that cannot be disclosed pursuant to confidentiality restrictions.
OUTCOME:
Acted as second chair trial counsel in an automotive manufacturing defect case against one of the largest school bus manufacturing companies in the United States, obtaining a jury verdict in excess of ... $200,000.00 + an award of reasonable attorney’s fees and proving that the company committed intentional fraud, in that it knowingly manufactured 57 overweight and dangerous motor homes and sold them to unsuspecting customers.
