Mr. Sowa was charged with Trespassing on a Key Facility which is a felony punishable by up to four years in prison. The Department of Homeland Security and the FBI both put tremendous pressure on the O ... ttawa County Prosecutor to make an example of Mr. Sowa. The dominant issue in the case was weather the key facility on which he was accused of trespassing was in compliance with the Michigan statute thus allowing the simple trespass charge to be elevated to a felony. The 58th District Court held that it was not, the 20th Circuit Court affirmed, and the Michigan Court of Appeals declined leave for an additional appeal.
