Tough Week: 3 DUI's in 5 Days
Jul 01, 2010
OUTCOME: 18 Months Suspended Sentence, 2 Years Supervised Probation, Mandatory Drug & Alcohol Counseling
My client received her first ever DUI charge on a Monday. The second came on the following Wednesday, and the final one was that Thursday. Obviously this was an unusual situation and the facts provide... some clarity: she had started a new medication which was interfering with another drug she was already taking. Nonetheless, it was necessary to present the Court with a strong and convincing argument that this was the result of a "perfect storm" of factors and not the most negligent person to ever get behind a wheel. First, I consolidated all three cases in an effort to highlight that the charges were all related and occurred in four days. After more than one trial, and much effort communicating with the State's Attorney's Office and numerous drug and alcohol resources, I presented the trial Judge with an argument that put a face on my client and an idenitty where most only saw an incredible course of events. In the end, my client received a suspended sentence, probation, and mandatory attendance in several programs. I was told by everyone that keeping her out of jail would be impossible and not even worth pursuing. Every situation has a person with a real story at it's core and by bringing that to light, an extremely unlikely, but correct, sentence was handed down.
