This was a claim by a borrower for statutory damages allegedly committed by the lender who made the second mortgage loan to the borrower. The claim was asserted against our client, the company to whom ... the loan was later assigned and who did not commit any violations itself. The loan had been paid off when the suit was filed. We argued for our client that the mere fact that the loan was later assigned to it did not make it liable. The case was decided by the Court of Appeals, our highest court, in a ruling completely favorable to our client, who was found not responsible.
