After uncontested eviction, Landlord attempted to collect remaining 7 months’ rent ... due of $7,738.72; plus $570.87 in damages for carpet & paint, $386.94 late charges, $65.50 court costs (less $1,236.00 sec. deposit with interest) totaling $7,576.03 plus $1,136.40 in attorney’s fees. After discovery and a one hour trial, court found that the Tenant breached but that Landlord essential failed to prove that it mitigated its damages and awarded Plaintiff $1,868.10 principal, $128.97 interest, plus costs and $280.22 attorney’s fees.

Md. Home Improvement Contractor Marcus Adams t/a Thermal Marketing Systems installed Hardiplank siding on residential dwelling allegedly without following the manuf.'s installation instructions. He co ... mpletely left out the butt joint flashing on all joints. The evidence also showed he did not install starter strips nor did he stagger the butt joints which is an industry standard and he installed window trim by cobbling pieces together instead of using trim designed for the job. In a second contract, evidence was shown that he installed on a chimney natural thin stone work (exterior and interior)) in a manner that was argued as slipshod, uneven, full of voids, unattractive, and lacking proper workmanship as was evident in the other work performed on the premises. The District Court of Md. awarded damages of $18,030 to my clients.

Represented the Applicant regarding a Specific Design Plan application before the Prince George's County Planning Board known as SDP 9207-01. The Application included a request for approval for an ad ... ditional 3,610 sq. ft. of gross floor area to the existing church and school building (a.k.a., the Washington New Church and School) for a total of 16,725 sq. ft. Staff asserted that the subject property was considered an “acreage parcel” or was otherwise subdivided by deed; and, that before the current application (SDP 9207-01) can be considered, a new preliminary plan of subdivision may be required pursuant to Section 24-107 of the Subdivision Regulations for total development of more than 5,000 square feet of gross floor area being constructed after January 1, 1990. To avoid a time consuming and expensive added review, the Church disagreed and argued that the Applicant is exempt from the requirement of filing a preliminary plan and final plat of subdivision because the proposed use is for an addition to an existing school facility for which no increase in existing enrollment is proposed by the Application as provided as an exemption from the need to obtain a preliminary plan under the subdivision ordinance.
