A.P. was indicted for second degree murder. He was accused of participating in a speed contest with another man in which both vehicles collided at approximately 115 mph and one vehicle collided with a ... tree and the driver was killed. A.P. faced a sentence of 20 years to life if convicted of the second degree murder charge. After a week long trial which involved accident reconstruction experts and the testimony of a toxicologist, A.P. was found not guilty of second degree murder. He was convicted of involuntary manslaughter, an offense which had a maximum possible sentence of eight years - and was an offense to which he had been prepared to plead guilty before trial. At sentencing, the government sought the maximum sentence of eight years. A.P. was sentenced to a sentence of only 60 months
