OUTCOME: $450,000.00 Settlement
Our client was struck on the upper back and shoulders by a poorly-maintained gutter at a condominium complex in northwest Milwaukee. The gutter was full of ice and snow and knocked the man to the grou...nd as he was leaving through the front entrance. His injuries were serious and required neck and back surgery. Nevertheless, the condominium association and their insurance company denied his claim. Attorney Timothy W. Schelwat was able to negotiate a $450,000.00 settlement shortly before the case went to trial.

$175,000 at Mediation in Pit Bull Mauling for Helping Hospitalized Friend, Insurance Claims Trespassing
N/A
OUTCOME: $175,000
On August 16, 2009, a 29-year-old female was doing a favor for her hospitalized friend when she was viciously attacked, repeatedly bitten on her arms and legs by his pit bull. She sustained significant... scarring from the many puncture wounds and incurred medical expenses and lost wages totaling $30,000.00. American Family, the friend's homeowners insurance, alleged that she was trespassing on the property and denied payment on her claim.
Attorney Tim Schelwat of Hupy and Abraham in Milwaukee filed a lawsuit on her behalf and discovered that she had gone to the residence at her friend's request with his housekeys to retrieve a laptop computer, cell phone charger and toothbrush for him. Attorney Schelwat also found out that the pit bull had bitten someone previously, therefore raising the prospect of a double-damages award pursuant to Wisconsin statute.
The case was thereafter mediated and American Family agreed to pay $175,000.

OUTCOME: $750,000 - Two Settlements
In a two-week span in late October and early November of 2011, Illinois motorcycle accident attorneys and Wisconsin car accident attorneys at Hupy and Abraham settled two separate accident claims at me...diation for three-quarters of a million dollars each.
Illinois Motorcycle Accident
In a small Illinois town between Springfield and St. Louis, our client was a passenger on her husband's motorcycle when a driver, exiting her driveway, pulled directly into their path. Our client suffered a head injury with residual memory loss and difficulties hearing, comprehension and sentence formulation.
The clients knew of Hupy and Abraham's experience helping injured bikers prior to the accident after hearing a representative speak at an Accident Scene Management Instruction (ASMI) course in Wisconsin.
Attorneys Timothy W. Schelwat in Milwaukee and Vito J. Manicioto in Gurnee negotiated the $750,000.00 settlement with the defendant's insurer after a two-day mediation session.
Wisconsin Car Accident
On Brown Deer Road in Wisconsin, our client was driving home after working a morning shift in the right lane to a ramp leading to Highway 57 when a driver drove directly in front of him and caused a collision. The defendant was attempting to get on the same ramp from the opposite side of Brown Deer, allegedly waved through by a car in the left lane that was backed up for a traffic light, which did not apply to our client, and failed to properly observe whether there were any vehicles in the right lane.
A manager of a local fast food restaurant, he sustained a major injury to his right knee that required five different surgical procedures that included total knee arthroplasty.
This case was also settled at a mediation by Attorney Timothy W. Schelwat of Hupy and Abraham in Milwaukee for $750,000.00.
