OUTCOME: DUI dismissed, pled to non-alcohol moving violation
Client charged with DUI on a refused chemical test. Because we were retained nearly immediately after the arrest, we were able to preserve very exculpatory video evidence from the jail booking desk wh ... ich put us on a solid footing to seek dismissal of the alcohol-reated charge based on client's innocence, including securing the testimony of the booking deputy as a defense witness. Plea deal was struck less than a month before scheduled jury trial. Obtained this deal from the prosecutor despite the apparent loss of the defense's most helpful trial witness do to his felony arrest for assaulting the defendant. The expectation was that the witness would take the fifth at the DUI trial due to the seriousness of the felony charges and the deterioration of the relationship between he and my client.
