Recently, the single adult daughter of her deceased mother came to me after being treated unfairly in property division by her step-father. Importantly, she was told (wrongly) by the step-father that b ... ecause her mother's Will was "so old," it wouldn't be admitted to probate and she allowed it to be thrown away. The estate was being probated as if no Will existed. After some digging, we found a copy of Mom's signed 1980's Will - which left ALL of her property to her daughter and none to the step-father. Needless to say, some correct legal advice and diligent work to obtain and have the copy of the Will authenticated and admitted to probate completely changed the property distribution that my client received. She had a very happy 2017 Christmas.
