In this case, my client was driving his Semi-Trailer when traffic on the freeway slowed due to weather conditions. Another Semi-Trailer, fully loaded, failed to stop and struck him from behind. The c ... lient was required to undergo extensive treatment, including surgery for his cervical spine. The evidence provided by his physicians was supportive in some of his records, but not in others. There was a significant debate about the actual force involved in the impact and whether it was the medical cause of his surgery and continuing soft tissue complaints. In addition, there were some pre-existing neck problems prior to the accident occurring.
