This is a medical malpractice case arising from the stillbirth of Bonnie Pierce's daughter. Negligence was proven against the obstetrician and hospital where Bonnie Pierce had been in labor. The defe ... ndant insurance companies tried to argue that Bonnie Pierce was not entitled to recover damages for her own emotional distress because she was merely a bystander. The case was briefed to the Wisconsin Court of Appeals. It was then appealed to the Wisconsin Supreme Court. Briefs and oral arguments were made to the Supreme Court.
