The motormanufacturer, Evinrude, had designed the motor to be able to start in gear even though its owner's manual warned users to always start the motor in neutral. Evinrude chose not to use a design that would have easily prevented the motor from starting in gear. Jury found in favor of client and its award included punitive damages against Evenrude, which was owned by Outboard Marine Corp.
