My client suffered a debilitating stroke roughly 40 hours after being treated in an emergency room. After a two week jury trial, the trial court dismissed the Plaintiff's claim for medical malpractice ... based on the theory of lack of informed consent. The Court of Appeals affirmed. I argued to the Supreme Court that a new trial was warranted on the issue of informed consent, since there was evidence that the treating doctor failed to properly inform the patient of an alternative treatment course. The Supreme Court reversed the Court of Appeals and Trial Court, and remanded the case for a new trial on the issue of informed consent.
