U.S. Dept. Transportation by the U.S.Coast Guard sought to demolish the historic Devil's Island Lighthouse and replace it with a modern "solarized" structure in the Apostle Islands National Lakeshore, ... in the southern part of Lake Superior. Plaintiffs filed suit in federal court seeking compliance with 16 U.S.C. §470 and 49 U.S.C. §303 (the National Historic Preservation Act) and accompanying regulations. Plaintiff -intervenor National Trust for Historic Preservation (represented by Rankin) sought and was granted intervenor status. Plaintiffs were ultimately granted summary judgment, defendants were enjoined from proceeding, and plaintiffs were awarded a rare grant of attorney's fees and reasonable costs.
