OUTCOME: Reversed

I represent Mr. Iverson and we won a motion to suppress the stop of his vehicle that was made after a backseat passenger tossed a cigarette butt out the window. The State appealed to the Wisconsin Cou ... rt of Appeals, which affirmed the dismissal. The State then petitioned the Wisconsin Supreme Court which determined that the stop was warranted as a cigarette butt was found to constitute solid waste under the State's solid waste disposal statute. The matter has been remanded to the trial court where we negotiated a favorable disposition that allowed my client to keep his job.

This case involves a probate dispute relating to joint tenancy accounts and whether they should have been included in a probate estate. The technical issue was whether the doctrine of "issue preclusi ... on" mandated that the accounts be included in the estate because they previously had been included in a guardianship inventory for the decedent.
