My client alleged that a lawfirm obtained and used her consumer report from a credit reporting agency after she communicated a potential claim against one of the firm's clients, and it did so for the p ... urpose of checking her out in anticipation of litigation. We filed the complaint on behalf of the individual/plaintiff alleging that the defendant-lawfirm violated the Fair Credit Reporting Act by obtaining a credit report for an impermissible purpose. After discovery was completed, both the plaintiff and defendant requested the court to enter judgment in their favor on some or all of the issues but for damages.
OUTCOME: Successfully Obtained a Judgment for the Employees for Overtime Pay
On behalf of 10 employees, we sued the employer and its principal officer to hold them responsible for and recover unpaid wages due to overtime pay violations.

We won the trial, and the employer and carrier appealed. The appellate commission reviewed the trial, ordered additional medical and vocational testimony. The additional testimony was once again in conflict, but the commission affirmed the trial result.

After an evidentiary hearing, the court found against the City, finding that the state agency has jurisdiction over my client's claims against the City. The City filed a motion for reconsideration, which the Court also denied.
