Circuit Judge John Albert ruled that troopers w ... ho work an eight and a half hour shift must be paid for their lunch breaks because work rules require that they stay in uniform, eat at restaurants near their assigned highways, remain armed, keep their radios turned on and not run any personal errands. "Allowing them to eat during that same time cannot be termed a meal break which goes uncompensated," Albert wrote. "They are working and, therefore, must be paid."
