Commonwealth v. Clemens
N/AOUTCOME: Conviction vacated and charges dismissed
The Appeals Court of Massachusetts threw out client's criminal harassment conviction in Commonwealth v. Clemens, the first appellate decision interpreting the state's criminal harassment statute. Tom ... did not represent Mr. Clemens at trial, and was retained just for the appeal. Tom convinced the appellate court that his client's actions did not amount to harassment under the statute, and the court ordered that the charges against Mr. Clemens be dismissed.
