May 12, 2011OUTCOME: Court of Appeals remanded the case for partition, but affirmed the order of the Circuit Court that the home was not a gift in contemplation of marriage.
Parties were engaged to be married and cohabitated in home purchased by the Petitioner. He later quit-claimed a one-half interest in the home to Respondent. When the relationship soured, litigation en ... sued. The Circuit Court issued an order to the Petitioner to pay Respondent 1/2 of the value of the house, as determined by the Court. Petitioner appealed, seeking a ruling that the home was a gift in contemplation of marriage or, alternatively, that the home must be partitioned by sheriff's auction.
