Defendant was charged with Assault causing Serious Bodily Injury (married) with a Deadly Weapon. This is a first-degree felony which carries a punishment of up to 99 years or life. My client insisted t ... hat he was the victim of his wife's physical aggression, and that he only pushed her away in self-defense. A thorough examination of the medical records (with the aid of an assistant, who is a physician) revealed inconsistencies between the medical reports of two hospitals where the complaintant had been treated. As a result, there was some question as to whether the State could prove that complainant had suffered the "serious bodily injury" she claimed. In addition, I was of the belief that the State would be unable to prove use of a "deadly weapon". Two weeks before trial, the State offered a plea of 21 years in prison. I convinced my client not to accept the offer, and we instead prepared for trial. Moments before the trial was to begin, the State dismissed all charges against my client and he was freed from detention.
