Plaintiffs argued they had an implied easement to use the road they had used for 18 years despite it not being recorded. Plaintiffs filed a Motion for Summary Judgment.

My client, Rogers built a beautiful home in an Eagle Point subdivision. A developer purchased the residential lot across the street from Rogers and punched a road through the lot to provide road acces ... s for an adjoining subdivision after obtaining approval from the City of Eagle Point to do that! The approval came without legal notice to Rogers and the approval violated Roger's subdivision CC&Rs. Rogers appealed the City's approval to LUBA.
