OUTCOME: Reversed summary judgment against Defendant
Defendant was late on multiple occasions forwarding Plaintiff's garnished child support to the State. Plaintiff sued to recover entirety of late payments plus penalty to the State and attorney fees. ... Pro-tem judge granted Plaintiff's motion for summary judgment and Defendant appealed. Case was one of first impression regarding ORS 25.424 and whether a child-support payor could sue an employer for failing to timely forward garnished child-support payments. Court of Appeals agreed with Defendant, who argued that Plaintiff lacked standing and the statute did not provide him with a cause of action. Decision was reversed. Plaintiff petitioned for review to Oregon Supreme Court. State of Oregon filed a brief agreeing with Defendant's argument. Supreme Court denied review. (344 Or 401 (2008)). Plaintiff then dismissed his lawsuit and repaid Defendant monies that had been garnished after judgment but before appeal.
OUTCOME: Reduced $11,840 judgment to $450.
Pro-se Plaintiff appealed $450.00 municipal court judgment for building code violation to circuit court. Plaintiff failed to appear at hearing and default judgment was entered against her, awarding Ci ... ty $11,390 in attorney fees and costs. Prior to entry of judgment for costs and fees, another judge had signed and the court had entered a judgment of dismissal because the City had not submitted a judgment. More than two years later, Plaintiff learned of the judgment against her and hired me. I successfully set aside the judgment against her. However, trial court simultaneously set aside the judgment of dismissal. We appealed the court's action in setting aside the dismissal of the judgment of dismissal. City moved to dismiss the appeal. We prevailed, and the City then agreed to dismiss the case in exchange for payment of the original $450.00 fine.
OUTCOME: Defeated motion to dismiss appeal.
Court of Appeals directed Plaintiff to show cause why appeal should not be dismissed for lack of appealable judgment. Defendant City of Tigard then moved to dismiss Plaintiff's appeal of an order sett ... ing aside a judgment of dismissal. City argued that the order was not subject to appeal because it was not a final judgment. Court of Appeals issued opinion giving first analysis of new appellate statute that changed the rules for what constituted an appealable decision. Court denied City's motion to dismiss. Case subsequently settled.
