On September 26, 2007,Police were called to clients home by her father. He feared that she was suicidal and was intoxicated. Client was a repeat DUI offender and had a significant drinking problem. The ... police arrived at her residence and di not find her or her vehicle. Shortly thereafter the police arrived and noticed client car in her driveway. They entered her home and did not find her. On the way out they looked in her vehicle and found her hiding in the front seat with a half full bottle of wine. She was arrested and submitted to a breath test indicating a blood alcohol level well over the legal limit. The defense was premised on the lack of proof of alcohol level at time of driving. Given the circumstantial evidence, the court acquitted he defendant of the Drunk driving offense. The Judge opined that he truly believed that the defendant was DUI when driving, but the evidence and argument did not necessarily lead to that opinion being the only plausible explanation. While she was acquitted of the felony charge of DUII and avoided a 20+ month state penitentiary sentence, the judge gave her a sizable sentence for driving while suspended. The judge was honorable and courageous as well as fair. It took allot of guts for the judge to rule as he did and for that he has earned my professional respect. While the case took nearly two years of work, the result was well worth it.

Client was lawfully stopped on January 24, 2008 for poor driving and was arrested for DUI on alcohol and drugs. Initially he had a court appointed attorney representing her, but felt that the complexit ... y of the case was above the experience level of her then attorney. So, she hired me to help her. I am glad that she did. Her case presented some very good areas of cross-examination and divulgence of the full facts and truth of the case. The prosecutor was intelligent, honorable and courageous enough to realize that flaws in the State's case. As a result the case was dismissed. The client was very satisfied. Ii am sure the jury was appreciative as well. Although the case took allot of time and energy, the result was satisfying and appropriate.

After a lengthy trial, Mr Bowers was acquitted of driving under the influence. Breath test result was over the legal limit and according to the police officer, Mr. Bowers "failed" the field sobriety te ... sts. Through cross-examination the truth of the breath test device and the field sobriety tests was presented to the jury. This intelligent jury reached the correct decision. Mr. Bowers was very satisfied with the results as it enabled him to keep his job and his reputation.

Client was contacted after a report of a "road rage" incident. The complainants were private security guards. They described erratic driving. Called the police and were interviewed by the police. All v ... ehicles were stopped at a gas station. Mr. Zech had been drinking just prior to the incident. He was perceived to be less than cooperative with the many police officers who arrived at the scene. Mr. Zech was eventually taserred (electrocuted) and removed from his vehicle and placed on very hot road surface during a 100 degree plus day. He received serious burns and taken to the hospital. The officers testified that Mr. Zech appeared intoxicated and his belligerent attitude seem to support that belief. But, Mr. Zech did nothing more than react as he felt an American should be treated. That is with cordiality. After a lengthy trial Mr. Zech was acquitted of the serious charges. He saved his commercial driver license and was satisfied with the results.
OUTCOME: Found Not Guilty by Jury
Client was driving his car when he hit another vehicle. The accident occurred in the morning. When the police arrived they immediately concluded that my client was under the influence of something. He ... took a breath test that registered slightly below the legal .08 threshold. The client admitted that he was a vicodin user and was prescibed the same. Vicodin is a narcotic analgesic. Client submitted a urine sample whcih disclosed the vicodin. A police Drug Recognition Evaluator performed tests on the client. At the end, the Drug Recognition Evaluator concluded that the client was under the influence of a controlled substance (vicodin) and alcohol. Cross-examination at trial revealed the biases and mis-diagnosis of the client. He was not under the influence. His mental and physical faculties were as good at the time of his arrest as at any other time. The jury saw the truth and embraced it.
