OUTCOME: Case dismissed
This second arrest case was dismissed based upon a speeding stop and allegations of lane travel violations. The speeding was based upon a visual estimate (pace). The officer could not articulate a r ... easonable basis to believe that the stop was well founded. He could not explain if he took into account the grade of the road or the rate of approach. The alleged lane travel violations were not sufficient to warrant the stop.

Thei client came into my office after she was involved in a two car accident that resulted in the death of the other driver. OUr investigater was able to locate witnesses that confirmed theat the othe ... r driver was completely at fualt. The case was declined as a felony. It was charged as a DUI as a result of a blood test that showed a .16 blood concnetration of alcohol. We filed motions to suppress the blood based on the handleing of the sample. The offcier kept it in his trunk all day and then put it in a refridgerator at the police station before using UPS to send it to the tox lab. The lab failed to calculate the uncertianty oftheir measurements and returned the sample ot the police despite a court order directing them to maintian it. In the end my client was offered a plea to Negliegent Driving in the first degree. That is a simple misdemanor with no loss of license or mandatory jail.
OUTCOME: State Supreme Court Unanimous Decision
This case, along with the companion cases were litigated from the trial court through the State Supreme Court. I was able to establish that the Washington State Patrol and its Breath Test Section co ... mpletely failed to calibrate, certify or validate thier scientific instruments. This resulted in the State Supreme Court throwing our every breath test in the entire state as unreliable and invalid. Recently, Attorney Ted Vosk has taken this work to an even more dramatic result, establishing that the entire Washington State Toxicology Labrotory and its work lacked scientific reliability.
