Factual issues involved the technological requirements for creating steel strip with particular physical characteristics, the suitability of different electric motors applied to the process, demand and pricing for the finished product that was to be produced by the mill and cost accounting for the milling and selling processes. The case was tried to a jury for three weeks and the jury deliberated three days. The jury returned a vedict for plaintiff. The damage award by the jury was approximately $3.6 million. The defendant appealed from the verdict, but dismissed the appeal shortly before its opening brief was due and the judgment, with some interest, was paid in full.
