Found that i ... t was not reasonable under state statute to deem that the petitioner was unable to perform a second breathalizer because petitioner became ill after taking first test. Rather than make reasonable efforts to administer second test, officer determined the petitioner unable to perform test contrary to state law. Petitioner's driving privileges restored.

Petitioner arrested and charged with DUI after police found him asleep in the driver's seat of his motor vehicle in a private parking lot with the engine running. As a result of a Per Se hearing at the ... Department of Motor Vehicles, the Hearing Officer for the DMV found that the Petitioner was NOT operating a motor vehicle as defined in the Connecticut General Statutes after counsel elicited testimony from the Petitioner which revealed that he had pulled off the road to sleep and left the motor vehicle running for heat. Albeit uncommon, this result was a major victory for the Petitioner who would have otherwise lost his license to operate a motor vehicle for a period of up to 1 year. Instead, the Petitioner's driving privileges were immediately restored with no further action taken.
