First Constitution Bank v. Harbor Village Ltd Partnership
Sep 13, 1995OUTCOME: Court upheld validity of mechanic's lien
I was co-counsel on this case, which involved the validity on appeal of a mechanic's lien that the lender argued was invalid due to recording defects. The case broke legal ground by using cases that c ... ourts had decided upholding the validity of mortgages and applied them to uphold the validity of a mechanic's lien. Case was first briefed and heard at the CT Appellate Court, which rejected the validity of the lien. The CT Supreme Court then elected to hear the case and reversed the Appellate Court and upheld the validity of the lien resulting in a full recovery for our client.
