June 4th, 2009 Plaintiff's Attorney: James G. Williams, Esq Description of Case: Jean Korner commenced this action against David M. Walters, M.D., William Pennoyer, M.D., and Colon and Rectal Surgeons of Greater Hartford, LLC. Jean Korner underwent a laproscopic mesh repair of a parastomal hernia on April 12th, 2004 at St. Francis Hospital in Hartford. The surgery was performed by David M. Walters, M.D. In the immediate post-operative period a loop of small bowel had re- herniated through the mesh causing incarceration and strangulation of a portion of the small bowel. She was rushed for emergency surgery the following day. The emergency procedure was performed by William Pennoyer, M.D. Dr. Pennoyer performed an exploratory laparotomy, small bowel resection with primary anastomosis, repair of parastomal hernia with mesh and relocation of ileostomy. During the course of the April 13th procedure the plaintiff contends that Dr. Pennoyer injured the small bowel by creating an enterotomy. The surgery normally requires the small bowel to be thoroughly inspected to ensure it was not injured prior to closing the patient's abdomen. The abdomen was closed at the completion of the surgery without discovery and repair of the hole in the small bowel thereby causing a leakage of bile into the abdomen over days. The patient became septic and was returned to the operating room for a third surgical procedure which took place on April 16th, 2004. As a result of the infection mesh in the patient's abdomen was removed and the wound was left open through the use of retention sutures to promote healing. The patient had a lengthy rehabilitation stay and remained an in patient through the 16th of June, 2004. Due to the peritonitis which she experienced as well as adhesions created during the course of the surgery, Mrs. Korner had reoccurrence of multiple hernias with ongoing discomfort and limitation of activity. Plaintiff's experts testified that both Dr. Walters and Dr. Pennoyer deviated from acceptable medical standard of care. Dr. Walters in allowing the mesh to be placed too loosely at the time of his hernia repair thereby resulting in a technical failure of the procedure and Dr. Pennoyer in failing to discover and repair the enterotomy infra-operatively. The jury deliberated for approximately 5 hours over two days before returning a verdict in favor of the plaintiff finding fair damages in the amount of one million seven hundred and fifty thousand ($1,750,000.00) dollars (one hundred thousand {$100,000.00} dollars of which was awarded to the plaintiff's spouse on his Loss of Consortium claim).
