The homeowners appealed the property tax assessment amount found at the last town-wide revaluation. The homeowners claimed that the City had the wrong lot size measurements and did not take into acco ... unt the shared driveway, utility easements and s public way between the property and the Long Island Sound and functional limitations of the home (one bedroom only accessible via a spiral staircase). The Court, siting primarily the functionality problems with the home, found in the favor of the homeowners and reduced the assessed fair market value by $70,000, to the value found by their appraiser. The net result of the reduction in assessed value was a refund to the homeowner of over $10,000 for overpaid real estate taxes and an reduction of annual real estate taxes by approximately $4,000 until the next town-wide revaluation.
