Jan 01, 2011OUTCOME: Won liability in litigation. Found missed high value injury that previous lawyer missed. Settled case for more than 3x what the previous lawyer thought was the value.
Client was rear-ended at stop sign. Defendant tried to blame the client for 'stopping too soon'. Previous lawyer had missed client’s neurological issue (because he didn’t read the records) and made set ... tlement offer for $32K. Client fired the old lawyer and hired me. I deposed the defendant and learned that he was a habitual drunk-driver. I won liability on summary judgment and got the limits of the defendant’s (crappy) insurance policy, and pursued an underinsured motorist claim on the client’s policy. I ultimately settled the case for $65K, more than double what the previous lawyer thought it was worth. Lesson: Hire a lawyer who reads your medical records!... Case: J.M. v.
