On July 27, 2004, 38 year old Plaintiff Richard Graves went to the apartment of his former girlfriend and daughter in Georgetown, Texas. He brought with him a box of ammunition and a Tech 9, commonly ... referred to as a submachine gun. Graves threatened to kill his ex-girlfriend and her current boyfriend and himself. Plaintiff’s ex-girlfriend called 9-1-1 and deputies from Williamson County arrived at the scene. Graves was sitting Indian style on the landing of the second floor in front of his ex-girlfriend’s apartment as deputies arrived. The deputies ordered Plaintiff to raise his hand, at which time Plaintiff raised his left hand and lured the deputies up to the top of the stairs. Deputy Zachary upon arriving at the top of the stairs, saw a submachine gun pointed at Plaintiff’s head. Deputy Zachary ordered Plaintiff multiple times to drop the weapon and subsequent shot the plaintiff once in the groin area and once in the chest.

Plaintiff Joshawa Curlee, 27, a former patient of the Austin State Hospital was arrested by Killeen Police Officers for burglary of a building on January 1, 2002. Plaintiff was taken to the Bell Count ... y Jail on the felony charge. He attempted on two separate occasions to commit suicide. Plaintiff was placed on 24 hour watch and administered medication of Thorazine and Ziprexa by the Bell County Jail Doctor. After 40 days of confinement, Plaintiff complained of abdominal pain and administered a Fleet enema. Plaintiff sustained a ruptured bowel and underwent an ileectomy or bowel removal. Plaintiff sued Bell County under 42 U.S.C. §1983 for failing to provide adequate medical care.

Complainant alleged that on June 11, 1996, Waco Police Officers Kinlaw and Lauderdale arrested Plaintiff outside a nude entertainment establishment in Waco, Texas. Plaintiff alleged that during the co ... urse of the arrest, Officer Kinlaw repeatedly kicked and kneed Plaintiff’s groin area. Plaintiff alleged that Officer Lauderdale failed to intercede and prevent excessive force on the part of Officer Kinlaw. Plaintiff alleged that Officer Kinlaw failed to provide medical attention as a result of the alleged beating. Plaintiff sustained a ruptured testicle, which required surgical repair.
