On July 27, 2004, 38 year old Plaintiff Richard Graves went to the apartment of his former girlfriend and daughter in Georgetown, Texas. He brought with him a box of ammunition and a Tech 9, commonly ... referred to as a submachine gun. Graves threatened to kill his ex-girlfriend and her current boyfriend and himself. Plaintiff’s ex-girlfriend called 9-1-1 and deputies from Williamson County arrived at the scene. Graves was sitting Indian style on the landing of the second floor in front of his ex-girlfriend’s apartment as deputies arrived. The deputies ordered Plaintiff to raise his hand, at which time Plaintiff raised his left hand and lured the deputies up to the top of the stairs. Deputy Zachary upon arriving at the top of the stairs, saw a submachine gun pointed at Plaintiff’s head. Deputy Zachary ordered Plaintiff multiple times to drop the weapon and subsequent shot the plaintiff once in the groin area and once in the chest.
