OUTCOME: The deprivation of counsel for father rendered the judgment terminating his rights void.

A father failed to appear at the trial to terminate his parental rights. The court struck the appearance of his counsel prior to the trial, heard evidence and terminated father's rights. Father filed ... a motion to vacate the termination decrees because the deprivation of counsel during trial violated his constitutional rights. After the trial court denied the motion, father brought the appeal.

OUTCOME: Appeals Court vacated termination decrees, holding that mother's due process rights were violated, as the procedure deprived her of the right to be heard in a meaningful manner.

At a termination of parental rights trial, the Court heard offers of proof by counsel and did not hear any testimony from witnesses. The Juvenile Court terminated mother's rights and she filed a timel ... y notice of appeal. This appeal raised the question of whether the procedure of conducting a termination trial by offers of proof which disclosed disputes of material facts violated mother's due process rights.
