Plaintiffs, husband and wife both aged 59, were rear-ended while driving on the highway by another vehicle traveling at a high rate of speed. Both Plaintiffs were treated for soft tissue spinal cord in...juries.
Defendant’s insurer attempted to classify Plaintiff’s injuries as minor soft tissue injuries. As both Plaintiffs were not employed at the time of the accident, and nearing retirement age, Defendant’s insurer argued that neither Plaintiff was entitled to consideration for lost earning capacity or economic loss apart from medical bills and pain and suffering.
Plaintiff argued that although neither Plaintiff was employed at the time of the accident, one of the Plaintiffs was seeking employment and had a job offer shortly after the accident. Plaintiff obtained confirmation of the offer in writing, along with expert medical opinion that due to her injuries from the accident, Plaintiff was unable to perform the duties of the offered job.
After several months of negotiations, the parties ultimately agreed to settle the claims of both Plaintiffs for $124,000.
