Detained client who was unable to bond out sent his family to obtain a second opinion. Client's family retained me to represent him in removal proceedings. I decided that rather than filing a seco ... nd bond redetermination request, we should proceed to file and seek cancellation of removal before the Dallas Immigration Court. The client was detained and we were able to get a final merits hearing within 3 months. We were able to show the court that he met all of the elements and showed ample evidence that his qualifying relatives, two children, would suffer extreme and unusual hardship should the Respondent be deported to his home country. We demonstrated he had been living in the USA continuously for over 10 years and despite his most recent arrest, he was a person of good moral character. We provided ample evidence of the child's medical condition: heart disease as well as psychological issues stemming from their father's incarceration. We provided proof of educational and financial issues the children were suffering from prior to father's incarceration. Immigration Judge granted my client's case and since he was detained a visa was immediately available and my client was able to get his green card delivered in the mail within 6 weeks of being released from detention.
