Client was charged with Aggravated Assault with a Deadly Weapon and portrayed as a "Jack the Ripper"-style serial rapist during trial. Evidence included DNA (suppressed pre-trial), complainant's testim...ony, video of the scene during the alleged offense, and video of the defendant's interrogation by police. The Defendant was arrested bringing a new alleged victim to the alleged "rape trap" while officers were present responding to the first alleged rape.

Bad Breath Test Machine Damages 100s of DWI Cases

During the investigation of a DWI, we realized that one of the breath test devices (Intoxilyzer) used in Bexar County was not only defective due to a bad computer chip, but the Breath Test Technical Su...pervisor had maintained the machine and failed to notice. As a result, the DA's office was forced to put notice in every file affected and this is now a standard issue for impeaching the only Technical Supervisor in Bexar County. My client's case was dismissed on other grounds because it turned out that the defective machine wasn't used in his case.

The case was dismissed after we won a Motion to Suppress the Evidence based on a lack of reasonable suspicion to stop the defendant. He was stopped after a 911 caller began following his SUV and report...ing his location to police, describing the vehicle, and claiming that he had almost hit various motorists. When the officer pulled the SUV over, the 911 caller confirmed they had the right vehicle. However, by a detailed dissection of the arresting officer's testimony, we proved that at the moment of the stop, he lacked sufficient reason to suspect the vehicle was the one that the caller was referring to. All evidence after that point was suppressed, including a video so bad video that one prosecutor noted in the file "The Defendant looks hammered!" and demanded that he serve jail time for a first offense. That prosecutor was forced to sign the Motion to Dismiss.

The alleged victim claimed that our client stabbed him twice after starting a fight over his ex-wife. We argued self-defense and asked the jury for a fast verdict. They returned in about 30 minutes and... asked the prosecutors to arrest the victim.

In a case that was heavily reported by local media, our client was acquitted of a shooting outside Stacy's Sports Bar in which it was alleged that he had been involved in shooting four people, two fata...lly. He was positively ID'd by three people as one shooter and was on video. Originally charged with capital murder, our client was eventually tried on two counts of aggravated assault with a deadly weapon. The jury found him not guilty of actually shooting anyone but found that he had attempted to shoot one of the survivors. Neverheless, they awarded less than half the time the State requested despite hearing his extensive criminal history. Although found guilty on the second charge, our client was released within a week, pending his appeal. The co-defendant, whose attorney is now a District Judge, was given two life sentences.

Client was charged for urinating, at length and in front of a State Trooper, on the front of the Alamo in Downtown San Antonio. His felony case was dismissed, despite negative media coverage, after we... argued that urination did not result in perceptible damage to the Alamo, that the client did not voluntarily urinate on the Alamo, and that Ozzy only got a ticket (though the City Council later banned him from San Antonio).

Client was arrested after being featured on America's Most Wanted. She was a fugitive for 8 years after being charged with multiple counts of child molestation in Indiana. She was charged in Texas, w...hen arrested, for presenting a false identity to law enforcement. The first attempt by the State to extradite her to Indiana was defeated on technical grounds, but, after the Failure to ID case was dismissed, she decided to return to Indiana to see her family with whom she had no contact while she fled with her husband.
