My client, Mohammad Siddiqi sued Melinda Castro, M.D., a board certified anesthesiologist, for blinding his right eye following a routine anesthetic block for a cornea transplant. Dr. Castro refused to ... make an offer in response to Plaintiff's $250,000.00 demand. After a 4 day trial a jury awarded Mr. Siddiqi $1.45 million in damages. The parties settled the case prior to the entry of a judgment.
OUTCOME: Appellate victory for the Plaintiffs.
District court wrongly applied the Montreal Convention to dismiss Plaintiffs' claims. The 5th Circuit overturned the district court, and the case was allowed to proceed.

Ron Engh My relationship with Ron Engh evolved over many years. I began representing Ron in 2007 and did not stop representing him until the summer of 2012, when we finally resolved his case. After ... filing Ron's lawsuit in 2008 his case was initially dismissed by the trial judge. But the trial judge was wrong to dismiss the case, and we appealed that ruling. After over 2 years on appeal we convinced a unanimous panel of the 1st Court of Appeals in Houston that we were right, and that Ron had a legitimate case and should enjoy his day in court. It also happened that while our case was on appeal the trial judge lost his election. The newly elected judge was more considerate of Ron's claims. With the appeal resolved, Ron's case went back to the trial court, where we litigated for another year before confronting a jury. When the Defendant refused to settle for a reasonable amount we asked the jury to decide the case. The jury returned a verdict of over $337,000.00--virtually everything we asked the jury to award. We settled with the defendant post-verdict for a confidential amount.
