When you apply for a new visa, the consular officer would let you know. You should not be inadmissible given the code that the officer cited.

You would need to leave or if applicable, change status to another category. Employer could be on the hook for travel expenses.

No problem at all. The two applications are not related so not likely to be asked any specifics besides when you were in the US in H-1 status.
