I had a client who recently retained because she was unable to obtain a reduction in her sentence for cooperation that she previously provided. It was clear that she was entitled to the reduction, as t ... estimony was given in a trial against another defendant, and the Government indicated that it would move for the reduction. However, the motion for reduction in sentence was never forthcoming. After other lawyers tried to resolve the matter without success, the client hired me. After a series of communications with the U.S. Attorney's Office, the Government finally filed for the reduction. The judge granted the motion, and the client receive about a 37 percent reduction in her sentence. It took about five months from when I was retained in order to bring resolution to the matter.

The client retained me to assist with presenting a motion under 28 U.S.C. 2255, which is a mechanism federal prisoners can use to challenge their conviction and/or sentence after the normal appeals pro ... cess has run. The case is complicated because the underlying charges relate to health care fraud. However, despite the complexity of the case, we were able to present strong argument in relation to a claim of ineffective assistance of counsel tied to a plea offer the client asserts was never conveyed to him by his former attorney. In response to our filing in the case, the Government agreed that an evidentiary hearing is required to resolve the claim of ineffective assistance.

Shortly before the completion of one year of supervised release, the firm moved for early termination. The court granted the motion, and the defendant was discharged from supervised release one year to the day after release from federal prison.

Gregory Taylor was sentenced to ten years imprisonment following a jury trial in the District of North Dakota. After losing his appeal, Taylor hired the firm to assist him with a 28 U.S.C. § 2255 motio ... n. An evidentiary hearing was granted on Taylor’s claims of ineffective assistance against his two former trial attorneys. The district court granted Taylor § 2255 relief, finding that Taylor’s attorneys affirmatively misrepresented his chances of winning at trial, causing him to lose out on a two-year plea deal. In so holding, the court wrote that Taylor’s attorneys “fail[ed] to understand the basic law of conspiracy and how it might apply to Taylor’s case.” Taylor’s drug conviction was overturned, and Taylor was ordered released on bail. United States v. Taylor, No. 3:09-CR-69-9 (D. North Dakota).
