Client did poorly on the field sobriety tasks, and was ar ... rested for DWI. Client blew in the breathalyzer machine downtown, with a reading of 0.28 (3.5 times the legal limit). After investigating the basis of the stop, I requested a suppression hearing. At the hearing, the traffic engineer for Lubbock testified that the light was programmed to flash yellow, not red. Court suppressed all evidence obtained after the stop and the District Attorney's office dismissed the charges.
