Therefore, I argued that she did not refuse to take the chemical test as alleged. The DMV judge agreed and closed the case based on the officer's failure to prove the defendant refused the test. The client's driving privileges were reinstated and the client did not have to serve a one year revocation of her driving privileges.
OUTCOME: All matters resolved without points on license and without client serving jail time on the warrants.
Client was charged in two separate courts with multiple traffic violations. She did not answer the tickets and bench warrants were issued for her arrest.
