This ERISA case sought payment of LTD benefits wrongfully denied to our client's deceased husband prior to his death, as well as life insurance benefits payable to our client following his death. Mr. ... Bray suffered with brain cancer, which was misdiagnosed as depression. Therefore, after losing his job, he continued to seek employment, which was largely unsuccessful. Sun Life denied the claim insisting the post-termination work efforts established Mr. Bray's capability to work. The court disagreed, ruling that Sun Life's denial was arbitrary and capricious.

OUTCOME: Court agreed with Plaintiff that this was not an ERISA claim, and remanded the matter back to state court.
