OUTCOME: Prevailed. In an unpublished opinion, the Colorado Court of Appeals dismissed Husband's appeal, and remanded the case to the trial Court to address Wife's claim for attorney fees.
Husband appealed numerous issues entered by the trial Court at the Permanent Orders hearing. I defended Wife as against Husband's appeal.
OUTCOME: Prevailed. In an unpublished opinion, the Colorado Court of Appeals remanded the case to the trial Court to hold a hearing on the reasonableness and necessity of the GAL's fees.
My client (Father) appealed the trial Court's approval of fees for the Guardian ad Litem without the benefit of a hearing to determine the reasonableness and necessity of same.
OUTCOME: Prevailed. The Colorado Supreme Court ordered the District Court Judge to vacate its order requiring mediation.
