Fireman's Find was the performance bond surety for the general contractor, Pacific West Construction, Inc., on a construction contract with the plaintiff for the contruction of a middle school in Rigby ... , Idaho. Shortly after project completion, various problems developed with the construction that resulted in the plaintiff suing Pacific West, the architect, Fireman's Fund, and others. We prevailed on summary judgment based upon the plaintiff's failure to comply with the conditions precendent contained in the AIA Form 312 performance bond.
