Recently, I settled an employment discrimination/retaliation case. From beginning to end the case lasted one year, which is an unusually short time span given the complex nature of these cases. M ... y client was 51 years old, an employee of the company for 8 years. After he complained that a 29 year old employee had been assigned most of his accounts, he was fired. After I survived summary judgment and knocking out the employer's proffered legitimate reason for my client's firing, and in pursuing this case, I traveled to Belize and Long Island to depose witnesses favorable to us. One thing practitioners in this area need to know is that the jury instructions are a lot simpler in describing causation than the standard by which the court reviews the case at the summary judgment phase. In the end, all the hard work paid off with a very favorable settlement for my client.
