Wesp v. Everson, 33 P.3d 191 (Colo 2001)
Oct 15, 2001OUTCOME: VERY FAVORABLE
Landmark case on Attorney Client Privilege in Colorado. Here, the attorney was refusing to testify against his client when the Plaintiff insisted that he testify about statements made during the cours ... e of employment. The attorney was threatened with contempt of court and the attorney sought review by the state supreme court. The Colorado Supreme Court determined that a lawyer should not have to testify against a client, even after the clients death. Lawyers should generally take their clients secrets and confidences to their graves.
