On Dec. 6, 2011, Plaintiff Gil Ortuno, 59, a self-employed flooring installer, was driving a 2005 Ford Econoline van north on the feeder road of Highway 288 in Houston. He attempted a right turn onto Y ... ellowstone Boulevard on a green light. A Chevrolet 1500 pickup truck ran a red light on eastbound Yellowstone Boulevard, and Ortuno struck the pickup's passenger side. Ortuno claimed neck and back injuries. The pickup driver's insurance carrier settled with Ortuno for its $30,000 policy limit. Ortuno had underinsured motorist coverage with Allstate Fire and Casualty Insurance Co. Ortuno sued Allstate for underinsured motorist benefits. Plaintiff had a $100K UIM policy. Allstate only offered $5,400 to settle before trial.
