In 2006 King brought an action to set aside the 1999 tax sale of her property. James and Beaufort County asserted the two year statute of limitations barred King's action. The Master found the statute ... of limitations did not apply for lack of proper notice and King had maintained actual possession of the property. James and the County appealed. The Court affirmed the master and held that the statute of limitations did not begin to run until James took steps to withhold possession from King in 2005.
