OUTCOME: Assault Charges Dismissed.

Client came to me after being arrested in Manhattan for a misdemeanor assault outside a bar. Client had no memory of the events at all. He couldn't imagine having done what was alleged but was told t ... hat he was identified as person who seriously injured victim in drunken fight. We sent out an investigator who located some surveillance footage from a nearby business and discovered that client was in fact NOT the person who injured the victim. On the verge of indicting the case because of the serious injuries, the prosecutor's office dismissed the assault charges instead.

OUTCOME: Dismissal

Client pulled over supposedly for minor traffic infraction. Stop escalated out of proportion to stated justification for the stop. The police recovered a gun from the interior of a bag found in the d ... efendant's back seat. Client arrested and charged with criminal possession of a weapon and offered 7 years in prison as a "deal". I identified some potential Constitutional issues with the stop, took the matter to a suppression hearing, and filed a 40 page memorandum of law arguing for suppression of the gun. Motion was granted, gun was suppressed, and the case was dismissed.

We located surveillance video from a ... movie theatre more than 20 miles away showing my client leaving a movie at exactly the time of the robbery in New York City
