The charge was operating while under the influence of liquor. Two state troopers testified against my client. One of the troopers (the one who testified that my client failed the standardized field s ... obriety tests) was by the time of trial a field sobriety test instructor, and he was quite hostile and argumentative. The other trooper (the one who testified that my client failed the breath test) was by the time of trial working in the Office of Alcohol testing, and testified that he was qualified to repair and maintain the breath test machine. The jury found my client not guilty of impaired operation, and not guilty of operating with a BAC of .08% of higher.
